It is a condition of sale that orders are accepted subject to availability and that in the event of trees and shrubs supplied not being in accordance with the label or description or being otherwise unsatisfactory, our liability is limited to a refund of purchase price or supply new trees and shrubs.
All claims for trees and shrubs that are unsatisfactory must be received by Nishiki Nursery within 7 days of delivery date.
Trees and shrubs are dispatched from Nishiki Nursery in good condition. However, once delivered to either the customer or transport company then our liability ceases because we are then unable to ensure correct care of the trees and shrubs. Risk is ,therfore, assumed by the purchaser on delivery.
If any action is initiated by Nishiki Nursery to recover any debt, then any associated costs from this will be added to the debt.
